THURSDAY -April 2
- PREP for the debate!
FRIDAY -April 3
- DEFEND YOUR RIGHTS! Copyright debate.
- PERIOD 3
- good points were presented by both sides
- PRO - examples of what exactly you have a trademark for would have added to your argument; you referenced "a" trademark, but there was nothing shown to the court to substantiate your claims; samples of the cupcakes with the "trademark" would have added to your case. Think about what was actually filed with the court -- the documents explaining the suit were provided for both sides to review.
- CON - Claimed that there was no trademark -- be sure to site sources; issue presented was that the design in questions was used on the box rather than the cupcake; discussed the scope of what the trademark covered; if dot is not always the same color or used on all cupcakes, how can it be a trademark?
- BOTH PARTIES: needed more evidence; in trademark cases vital to show the actual evidence of the infringement and what the actual trademark covers.
- There was some confusion over copyright (creative work, like a story, poem, etc.) and a trademark (source identifier) on both sides.
- Some confusion was also expressed about what the case was actually about -- what was the basis of the suit and what rights have actually been granted to the Sprinkles client in the trademark. If this had been made more clear, the arguments would have stated a stronger case.
- Neither side provided exhibits for the court.
- VERDICT:The defendants admitted to using a similar "modern circle" on their boxes. This was the basis of the lawsuit. If the defendents had been using a similar candy decoration on their cupcakes, they may have prevailed in the case. The defendents did have a good claim that these types of decorations have been used by other bakers for years and that not all of Sprinkle's own cupcakes are sold with the trademarked item. The plaintiffs argued that the defendant's had used the signature mark -- the "modern circle"--on cupcakes, but did not provide the court with any evidence. The best evidence came, unfortunately from the defense that stated that Friends, LLC had, in fact, used the "modern circle" or something very similar on boxes, in the store as decoration, and also online. The use of the dot on the box is clearly a trademark violation. VERDICT FOR THE PLAINTIFF - however no damanges are being awarded as the plaintiff failed to prove that the use of the "modern circle" on the cupcakes had any negative impact on the Sprinkles' brand. Had the argument been made that there would have possibly been confusion with regards to the packaging presented by Friends, LLC, that might have changed the monetary award.
- PERIOD 5
- PRO - Be sure that you know the basis for your protection and what it covers; also re-visit the actual claim that you are making and be very specific as to what it is that you are suing for -- it is not the recipe that was in question -- use the case document that was given to both sides and the supplementary article which helped to outline your actual case; was it more that the dots were being used on the competitors cupcakes or that they were using the dots to help advertise the defendents' products? Towards the end you were starting to present more of the actual suit.
- CON - Well defended and you raised good questions for the court -- can a person truly trademark a "sprinkle" or a decoration that has been used by the baking industry as whole for years; the recipe section was well researched and had you stuck to that argument, it would have served your case well. You did, however, hand the SPRINKLES folks the case when you said that although you were NOT using the distinctive "modern circle" as it is called, on your cupcakes, that you did have something like it on your website, as decor in your shop, and something very similar on your packaging. The "modern circle" is something that is a trademarked item of the Sprinkles Bakery and could cause confusion about the identity of the source. Whereas there are some strong points made about the use of the confectionary dots and whether those alone would have trademark status, your clients were clearly in violation of the trademark "modern circle" when they were included in the packaging and wall decor in you shops, on your websites, etc.
- VERDICT FOR THE PLAINTIFF. Friends LLC are hereby noticed that they must stop using the "modern circle" on any marketing, store decor, websites, etc. The court finds, however, that there has not been substantial damage to the Sprinkles' Brand as cupcake decorations made from sugar have been used for years.
